MyMedicals Terms of Use

These Terms govern access to and use ofMyMedicals, together with the related support channels and webpages operated byDEVRECON.

1.INTRODUCTION, WHO WE ARE, AND ACCEPTANCE

1.1About these Terms and the Service

These Terms of Use govern your access to and use of MyMedicals, including the MyMedicals mobile application and the related support channels and webpages operated by DEVRECON in connection with the App. In these Terms, the words “DEVRECON,” “we,” “us,” and “our” mean DEVRECON Softwares Private Limited, and the words “you” and “your” mean the person who accesses or uses the Service.

1.2Important health notice

MyMedicals does not provide medical advice, diagnosis, treatment, clinical decision support, or emergency services. The Service is intended only for personal organization, record keeping, medication reminder support, and related tracking features made available in the App. You must not rely on the Service for emergency, urgent, time sensitive, or safety critical decisions. Always consult a qualified healthcare professional regarding medications, dosage, allergies, medical conditions, or treatment decisions.

1.4What these Terms apply to

These Terms apply to the MyMedicals mobile application for Android and iOS, our official support channels for MyMedicals, and the webpages we operate to support the App, including the webpages where these Terms and the Privacy Policy are made available. These Terms do not apply to third party websites, products, or services that are not controlled by DEVRECON, even if they are linked to or accessible through the Service.

1.5Acceptance of these Terms and eligibility summary

By creating an account, signing in, accessing, or using the Service, you agree to be bound by these Terms. By using the Service, you also confirm that you are at least 18 years of age, are legally capable of entering into a binding agreement under applicable law, and have provided accurate information in connection with your account. Additional eligibility and account requirements are set out in Section 2.

1.6Geographic availability

MyMedicals is intended for users in India. We do not direct the Service to individuals located in the European Economic Area, the United Kingdom, or Switzerland, and we do not knowingly offer the Service in those regions. If you access or use the Service from a region where we do not offer it, you do so without authorization and at your own risk. Our Privacy Policy may describe cross border data processing for operational reasons, but that does not mean the Service is offered outside the regions we identify for use.

1.7Use of the Service for another person

If you use the Service in relation to another person, including for reminders, record keeping, uploads, or sharing, you represent that you have the authority and all permissions needed to do so. You are responsible for the accuracy, completeness, and lawfulness of the information you enter, upload, manage, or share for that person. You are also responsible for ensuring that your use of the Service in relation to another person complies with applicable law and these Terms.

1.8Relationship to the Privacy Policy

Your use of the Service is also subject to the MyMedicals Privacy Policy. The Privacy Policy explains how we access, collect, use, share, store, retain, and delete personal data in connection with the Service. If there is any conflict between these Terms and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy will control.

1.9Platform terms

If you download or use the App through the Apple App Store or Google Play, you must also comply with the applicable terms, rules, and policies of that platform. These Terms apply between you and DEVRECON, and not between you and the platform provider, except where platform specific rights or obligations are expressly stated.

1.10Additional terms for iOS users

If you obtain the App through the Apple App Store, you acknowledge and agree that these Terms are entered into between you and DEVRECON, and not with Apple. DEVRECON, and not Apple, is solely responsible for the App and any maintenance, support, warranty obligations, product claims, or claims relating to legal or regulatory compliance, to the extent required under applicable law. In the event of a third party claim that the App infringes intellectual property rights, DEVRECON, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim. You also acknowledge that Apple and its subsidiaries are third party beneficiaries of these Terms as they relate to the iOS version of the App, and that Apple will have the right to enforce those Terms against you as a third party beneficiary. Your use of the iOS version must also comply with the Apple Media Services Terms and Conditions and any applicable Apple usage rules.

2.ELIGIBILITY AND ACCOUNTS

2.1Eligibility requirements

You may use the Service only if you are at least 18 years of age and are legally capable of entering into a binding agreement under applicable law. The Service is not intended for minors, and no person under the age of 18 may create or use an account.

2.2Age verification and accuracy of eligibility information

To create an account, you must provide the information we request for eligibility verification, including your date of birth. By creating or using an account, you represent and warrant that you are at least 18 years old and that all eligibility related information you provide is true, accurate, and complete. You must not provide false, incomplete, or misleading information in order to bypass age or eligibility requirements.

2.3Action if eligibility requirements are not met

If we reasonably believe that you are under the age of 18, or that you provided false or misleading eligibility information, we may refuse account creation, suspend access, restrict access, or terminate the account, in each case as permitted by applicable law and our Privacy Policy.

2.4Geographic availability and access condition

Your eligibility to use the Service is also subject to the geographic limitations stated in Section 1.6. MyMedicals is intended for users in India. If you access or use the Service from a location where we do not offer it, you do so without authorization and at your own risk.

2.5Account required for use of the Service

To use MyMedicals, you must create and maintain a valid account using a sign in or account creation method that we make available in the App. The sign in methods available to you may depend on your device, operating system, app version, and the current version of the Service. We may add, remove, limit, or modify sign in methods for security, operational, legal, or compliance reasons.

2.6Supported account and sign in methods

The Service may support account access through methods made available in the App at the relevant time. In the current version of the Service, account access may include standard account authentication operated through our service providers and, where offered in the App, Google Sign-In. If you choose to use a third party sign in method, your use of that third party service may also be subject to that provider’s own terms and privacy practices.

2.7Account information and profile details

You are responsible for providing and maintaining accurate, current, and complete account and profile information. Depending on the features you use, your account or profile information may include your name, email address, phone number if provided, date of birth, blood group, dietary preferences or allergies, and other optional profile fields you choose to submit. You acknowledge that inaccurate or outdated account or profile information may affect account access, support, recovery, reminders, sharing features, or other Service functionality.

2.8Personal nature of the account

Your account is personal to you and is for your authorized use only. You may not sell, transfer, assign, lease, or otherwise make your account available to another person. You may not create an account using another person’s identity or contact details without authorization, impersonate any person or entity, or create multiple accounts in order to evade restrictions, suspension, enforcement action, or other limits we apply under these Terms.

2.9Responsibility for account security

You are responsible for maintaining the confidentiality and security of your account credentials and for securing the devices through which you access the Service. You must use only authorized sign in methods, keep your credentials confidential, and take reasonable steps to prevent unauthorized access to your account. You are responsible for activity that occurs under your account unless and until you notify us of unauthorized access and we have had a reasonable opportunity to respond.

2.10Shared devices and device level access controls

If you access the Service on a shared device, or if you allow other persons to use a device on which you are signed in, those persons may be able to access information available through your account. If you enable device level access controls such as biometrics or device passcode based access, any person whose biometric profile is enrolled on that device, or who knows the device passcode, may be able to access the App on that device. You are responsible for managing device security and local access controls.

2.11Third party sign in services

If you use a third party sign in option made available in the App, you authorize us to receive and process the authentication and account linked information reasonably necessary to verify your identity, create or link your MyMedicals account, maintain secure sessions, and support account access and recovery. If your access to that third party sign in provider is revoked, restricted, unavailable, or otherwise interrupted, your access to the Service may also be affected.

2.12Unauthorized access and notice to us

You must notify us promptly through our official support channels if you know or reasonably suspect that your account has been accessed without authorization, your credentials have been compromised, or your account information has been used improperly. We may require reasonable verification before taking account recovery or account change actions.

2.13Our control over accounts

We may refuse registration, require verification, restrict account functionality, or suspend or terminate accounts where reasonably necessary for security, fraud prevention, abuse prevention, legal compliance, operational integrity, or enforcement of these Terms. Any such action will be subject to applicable law and the Privacy Policy where personal data handling is involved.

3.LICENSE, PERMITTED USE, AND PROHIBITED CONDUCT

3.1Limited license to use the Service

Subject to your continued compliance with these Terms, DEVRECON grants you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to download, install, access, and use the App and the Service on a compatible device that you own or control, solely for your personal and noncommercial use and only as permitted by these Terms and applicable platform rules. This license applies only to the object code version of the App made available to you. No source code rights are granted to you.

3.2Conditions of the license

Your license to use the Service is conditional upon your compliance with these Terms, the Privacy Policy, applicable law, and applicable platform terms and usage rules. Your license is also subject to any reasonable technical, security, operational, or compliance measures that we implement for the Service. If you violate these Terms, we may suspend, restrict, or terminate your license and access rights in accordance with these Terms.

3.3Personal use only

MyMedicals is licensed for personal use by individual users. Unless we expressly agree otherwise in writing, you may not use the Service as a clinical decision support system, a prescribing or dispensing system, a hospital or clinic workflow system, a medical records platform for institutional use, or a regulated professional healthcare service. If you are a caregiver or healthcare professional who uses the Service in any personal or supportive capacity, you remain solely responsible for your own professional, legal, and regulatory obligations.

3.4Ownership and reservation of rights

The App, the Service, and all related software, designs, layouts, interfaces, branding, logos, text, graphics, compilations, and other content and technology made available by DEVRECON, excluding your User Content, are owned by or licensed to DEVRECON and are protected by applicable intellectual property and other laws. Except for the limited license expressly granted in this Section, no rights are granted to you by implication or otherwise. DEVRECON and its licensors reserve all rights, title, and interest in and to the App and the Service.

3.5Permitted use and your responsibility

You may use the Service only for lawful purposes and only for the purposes for which MyMedicals is made available, including personal record keeping, reminder management, adherence tracking, storage of your own information, and optional sharing features made available inside the App. You are responsible for the accuracy, completeness, and lawfulness of the information you enter, upload, store, or share through the Service. You are also responsible for independently verifying medication, dosage, timing, allergy, dietary, and similar health related information before relying on it.

3.6Prohibited conduct

You must not, and must not attempt to, do any of the following.

  • Use the Service in violation of applicable law, regulation, court order, or third party rights.
  • Use the Service for any fraudulent, deceptive, misleading, abusive, harassing, defamatory, or unlawful purpose.
  • Impersonate any person or entity, misrepresent your identity or authority, or use the Service on behalf of another person without the permissions and authority required under these Terms.
  • Enter, upload, scan, store, or share information that you know is false, fabricated, misleading, unlawful, or unauthorized.
  • Use the Service as a substitute for professional medical advice, diagnosis, treatment, prescribing, dispensing, dosage verification, or emergency response.
  • Access or attempt to access accounts, systems, data, or features that are not authorized for you.
  • Interfere with, disrupt, damage, disable, overburden, or compromise the integrity, security, or availability of the Service.
  • Introduce malware, malicious code, harmful files, or other harmful material into the Service.
  • Probe, test, exploit, bypass, or circumvent any security feature, authentication control, access restriction, or protective measure used by the Service.
  • Use bots, scripts, scraping tools, automation, or other unauthorized technical means to access, copy, monitor, or interact with the Service.
  • Copy, reproduce, modify, adapt, translate, distribute, lease, rent, sell, sublicense, or commercially exploit the App or the Service except as expressly permitted by applicable law or these Terms.
  • Reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive the source code, structure, logic, or underlying technology of the App or the Service, except to the extent such restriction is prohibited by applicable law.
  • Remove, alter, or obscure copyright, trademark, proprietary, or legal notices associated with the App or the Service.
  • Use DEVRECON names, marks, logos, or branding without prior written permission, except as permitted by law solely to identify the App.
  • Collect, harvest, extract, or compile personal data or health related information from the Service or from other users without lawful authority.
  • Use information obtained through the Service for advertising, profiling, resale, brokerage, or any unauthorized commercial purpose.
  • Use any data, output, or material obtained from the Service to build or train a competing product, model, or service.
  • Use the Service in any manner that conflicts with the Privacy Policy or with permissions, consents, or restrictions required by applicable law.

3.7Updates, modifications, and feature availability

We may release updates, patches, bug fixes, security changes, and other modifications to the App or the Service from time to time. Some updates may be required for continued use of some or all features. We may add, modify, limit, suspend, or remove features at any time for technical, legal, security, operational, or product reasons. Availability of particular features may depend on your device, operating system, app version, account status, and region. We do not guarantee that every feature will always be available on every device or at every time.

3.8Third party services and platform dependencies

The Service may rely on or interoperate with third party services, infrastructure, authentication providers, analytics tools, notification systems, or platform services in order to function. Certain optional features, including scanning or extraction features, may also involve third party processing as described in the Privacy Policy. DEVRECON is not responsible for third party services that we do not control, including their availability, performance, or independent terms and policies. Your use of the Service may therefore also be affected by third party systems and platform conditions.

3.9Enforcement and action for misuse

If we reasonably believe that you have violated this Section or otherwise misused the Service, we may take action reasonably necessary to protect users, the Service, DEVRECON, or third parties. Such action may include issuing a warning, restricting access to a feature, requiring reauthentication or verification, removing access to certain content, suspending or disabling your account, blocking access from a device or session, preserving relevant records for investigation, or reporting the matter where appropriate to platform operators, regulators, or law enforcement. These rights are in addition to any other rights or remedies available under these Terms or applicable law.

3.10Survival

Any part of this Section that by its nature should continue after suspension, restriction, termination, or account deletion will survive to the extent permitted by law, including ownership provisions, use restrictions, enforcement rights, and protections relating to misuse of the Service.

4.MEDICAL DISCLAIMER AND HEALTH SAFETY LIMITATIONS

4.1Personal organization and record keeping purpose

MyMedicals is provided as a personal organization, record keeping, and adherence support tool. The Service is intended to help you store information, manage reminders, review your own records, and use related features made available in the App. The Service is not intended to replace professional healthcare services, clinical judgment, or regulated healthcare systems.

4.2No medical advice or professional healthcare service

MyMedicals does not provide medical advice, diagnosis, treatment, prescription services, clinical decision support, or professional healthcare supervision. Information presented through the Service, whether entered by you, shared by another user, or generated through optional processing features, is provided for convenience only and must not be treated as medical advice.

4.3No healthcare provider relationship

Your use of the Service does not create any doctor patient, pharmacist patient, hospital patient, dietitian patient, or other healthcare provider relationship between you and DEVRECON or between you and the Service. DEVRECON does not provide consultations, prescriptions, dispensing services, monitoring services, or emergency response services through MyMedicals.

4.4Professional verification required

You must consult a qualified healthcare professional regarding medications, dosage, timing, duration, interactions, contraindications, side effects, allergies, dietary restrictions, and treatment decisions. You must not make medical, medication, or health safety decisions based solely on the Service.

4.5Your responsibility to verify information

You are solely responsible for reviewing and verifying all health related information stored in, displayed by, uploaded to, shared through, or extracted through the Service before relying on it. This includes medication names, dosage strength, units, frequency, timing, refill details, allergy related information, dietary preference information, and information taken from prescriptions, labels, reports, or other uploaded documents.

4.6No guarantee of accuracy, completeness, or suitability

DEVRECON does not guarantee that any information available through the Service is accurate, complete, current, clinically appropriate, or suitable for your circumstances. The Service may reflect user entry mistakes, outdated information, incomplete records, transcription errors, sync delays, formatting issues, or incorrect extraction results from optional scanning or processing features. You are responsible for correcting inaccurate information and confirming important details with an appropriate professional or other reliable source.

4.7No prescribing, dosage calculation, or medication administration function

MyMedicals is not intended to function as a prescribing tool, dosage calculator, medication administration system, or substitute for pharmacy or clinical workflows. You must not use the Service to calculate, prescribe, approve, verify, or administer medication dosages for yourself or any other person.

4.8No emergency or time critical use

MyMedicals is not an emergency service and is not monitored for urgent medical events. You must not rely on the Service for emergencies or other time critical situations. If you believe that you or another person may be experiencing a medical emergency, seek immediate assistance from local emergency services or a qualified healthcare professional.

4.9Feature specific limitations still apply

Some features of the Service, including reminders, notifications, uploads, sharing, and optional scanning or extraction features, are subject to additional limitations and conditions elsewhere in these Terms. Those feature specific provisions supplement this Section and do not reduce your responsibility to verify important information independently before acting on it.

5.NO EMERGENCY USE, NOTIFICATION RELIABILITY, AND TECHNICAL LIMITATIONS

5.1No emergency service or emergency monitoring

MyMedicals is not an emergency service, emergency alert system, emergency response platform, or medical monitoring service. DEVRECON does not monitor users in real time for medical emergencies, contact emergency responders on your behalf, or guarantee that any reminder, alert, or notice will be delivered in time to prevent harm. If you or another person may be experiencing a medical emergency, contact local emergency services or a qualified healthcare professional immediately.

5.2Reminder and notification features are convenience tools

Reminder, alert, and notification features in MyMedicals are convenience tools intended to support your personal organization and adherence tracking. They are not fail safe, not guaranteed, and not a substitute for your own judgment, independent routines, caregiver oversight, pharmacy instructions, or professional medical advice.

5.3Notification delivery depends on your device and settings

The delivery and display of reminders and notifications depend on factors outside DEVRECON’s direct control, including your device settings, operating system behavior, notification permissions, battery optimization rules, internet connectivity, silent mode or focus mode settings, app version, and whether push notifications are enabled on your device. If notifications are disabled, restricted, delayed, or suppressed on your device, reminders may not reach you as intended.

5.4Delivery, timing, and accuracy are not guaranteed

DEVRECON does not guarantee that reminders, alerts, or notifications will be delivered, displayed, heard, timed correctly, or acted on at the exact scheduled time. Notifications may be delayed, duplicated, grouped, muted, dismissed, suppressed, or not delivered at all. Scheduled information shown in the App may also differ temporarily from what appears on a lock screen, notification tray, wearable device, or another linked device.

5.5Missed, delayed, or duplicate reminders may occur

You acknowledge that reminders may be missed, delayed, repeated, or shown out of sequence due to device state, operating system restrictions, connectivity issues, third party service interruptions, app background limitations, clock or timezone changes, synchronization delays, software defects, user configuration errors, or other technical causes. You are solely responsible for confirming medication schedules and taking appropriate action based on reliable sources, not solely on the presence or absence of a notification.

5.6You must verify schedules and reminder records

You are responsible for checking that medication entries, dosage instructions, frequencies, reminder times, refill related entries, and adherence records are correctly entered and saved in the Service. You must review important schedules periodically and correct any inaccurate, incomplete, outdated, or unintended entries. A reminder shown as scheduled, sent, missed, snoozed, or marked as taken does not by itself prove that medication was or was not actually taken.

5.7Syncing and cross device limitations

Where syncing is part of the Service, DEVRECON does not guarantee real time synchronization across devices, sessions, or app installations. Changes made on one device may take time to appear on another device, may fail to sync, or may appear differently depending on app version, connectivity, session status, or temporary service issues. You are responsible for confirming that important reminder schedules and records are visible on the device you actually rely on.

5.8Third party and platform dependencies

MyMedicals relies on third party and platform services to support notification delivery and related functions. On iOS, push notifications depend on Apple Push Notification service. On Android, push notifications depend on Firebase Cloud Messaging. DEVRECON does not control and is not responsible for the availability, routing behavior, throttling, delay, or failure of those services or of your device manufacturer, operating system provider, network provider, or internet service provider.

5.9Maintenance, outages, and feature changes

Reminder and notification features may be unavailable, interrupted, degraded, modified, or discontinued from time to time due to maintenance, updates, patches, bug fixes, security measures, infrastructure issues, provider changes, platform rule changes, legal requirements, or other operational reasons. DEVRECON may add, remove, limit, suspend, or modify reminder or notification features at any time where reasonably necessary.

5.10Independent backup responsibility

You must maintain independent backup methods for medication schedules, refill planning, and other important health related actions. MyMedicals must not be your only reminder system for critical medications, urgent timing, allergy precautions, or other safety sensitive matters. Appropriate backup methods may include written schedules, caregiver follow up, pharmacy instructions, calendar tools, pill organizers, or other systems that do not depend solely on MyMedicals.

5.11No uptime or performance warranty

DEVRECON does not guarantee uninterrupted availability, error free operation, minimum uptime, minimum latency, or any specific performance level for reminder, notification, scheduling, or related features. Any support or maintenance is provided on a reasonable efforts basis unless we expressly state otherwise in writing.

5.12Relationship to other sections and the Privacy Policy

This Section must be read together with Section 4, Section 6, Section 8, and the Privacy Policy. The Privacy Policy explains how notification related data, push tokens, reminder interactions, and related service provider disclosures are handled. If there is any conflict between these Terms and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy controls.

6.USER CONTENT, UPLOADS, SCANS, AND FAMILY SHARING

6.1Scope of this Section and meaning of User Content

This Section governs any content, data, files, images, notes, records, or other materials that you submit, upload, scan, store, share, or otherwise make available through the Service. In these Terms, that material is referred to as “User Content.” User Content may include medication records, schedules, reminders, notes, profile information, prescriptions, medical documents, photos, images, and content shared through Family Sharing or other in app sharing features. MyMedicals is not a public social networking service, and any sharing or visibility of User Content is limited to the features we make available inside the App.

6.2Ownership of User Content

You retain ownership of your User Content, subject to the rights you grant to DEVRECON in these Terms. Nothing in these Terms transfers ownership of your User Content to DEVRECON.

6.3Limited license to DEVRECON

To operate the Service for you, you grant DEVRECON a limited, nonexclusive, worldwide license to host, store, reproduce, transmit, display, process, format, and otherwise handle your User Content only as reasonably necessary to provide and maintain the Service. This includes use of your User Content to support storage, synchronization, reminder related functions, account functionality, user requested sharing, user requested scanning or extraction, security, troubleshooting, abuse prevention, legal compliance, and enforcement of these Terms. This license does not give DEVRECON ownership of your User Content and remains subject to the Privacy Policy and applicable law.

6.4Your responsibility for User Content

You are solely responsible for the User Content you create, enter, upload, scan, store, or share through the Service. This responsibility includes its accuracy, completeness, lawfulness, appropriateness, and whether you have the right to provide it. You must review User Content before saving it, sharing it, using it to create reminders, or relying on it for any purpose.

6.5Authority to provide information about another person

If your User Content relates to another person, you represent and warrant that you have the authority and all permissions or consents required to provide, upload, store, process, or share that information through the Service. If the information relates to a child or dependent, you represent and warrant that you are the parent, guardian, or other person with lawful authority to act for that individual. You are responsible for ensuring that your handling of another person’s information complies with applicable law and these Terms.

6.6Uploaded documents, images, files, and notes

The Service may allow you to upload or store prescriptions, reports, labels, images, files, and text entries or notes. Uploaded materials are treated as User Content under these Terms. Certain upload features may require device permissions such as camera access or photo access, and related features may not function properly if those permissions are denied or revoked.

6.7Optional scanning and extraction

If you choose to use prescription scanning or extraction features, the uploaded document or image may be transmitted to service providers used to perform the processing you requested, including the OpenAI API as described in the Privacy Policy. We have configured our current OpenAI API use so that our API inputs and outputs are not used to train or improve OpenAI models, but the provider may retain limited API content for security and abuse prevention purposes as described in the Privacy Policy. Scanning and extraction are optional features. If you do not want that processing to occur, you must not use the scanning feature and should use manual entry instead. Additional feature specific rules for scanning and extraction appear in Section 7.

6.8Third party information in uploaded materials

Documents and images that you upload may contain third party personal information, professional information, or health related information, including doctor names, clinic details, contact information, signatures, and similar identifiers. You must not upload, scan, store, or share any document or information relating to another person unless you have lawful authority and all permissions or consents required to do so. You are solely responsible for any consequences arising from your lack of authority or from your unauthorized handling of third party information.

6.9Family Sharing and other in app sharing features

MyMedicals may allow you to share selected information with another MyMedicals user through in app sharing or Family Sharing features. Sharing is optional and occurs only when you intentionally enable it. You are solely responsible for deciding what to share, with whom to share it, and whether continued sharing remains appropriate. You must review shared data and access permissions regularly and revoke access when sharing is no longer authorized or no longer appropriate.

6.10Effect of sharing and revocation limitations

When you share User Content with another user, that person may be able to view and, where the feature allows, use or edit the shared information inside MyMedicals. You acknowledge that a person with whom you share information may copy, record, remember, or capture what they can see, including by taking screenshots, and DEVRECON cannot control those actions after access has been granted. If you revoke sharing inside the App, the recipient should no longer have access to the shared view going forward within MyMedicals, but revocation does not undo information the recipient already saw, copied, recorded, or captured.

6.11No obligation to pre screen and our right to act on User Content

DEVRECON may, but is not obligated to, review, monitor, pre screen, or moderate User Content before or after it is uploaded, scanned, stored, or shared. We may remove, disable access to, restrict, preserve, or refuse User Content if we reasonably believe that it violates these Terms, creates legal, privacy, security, or safety risk, is subject to a complaint or legal request, or could harm users, third parties, the Service, or DEVRECON. We may also preserve relevant records or logs where reasonably necessary for investigation, security, legal compliance, or enforcement.

6.12Accuracy, verification, and reliance risk

User Content may be incomplete, outdated, inaccurate, mistyped, duplicated, incorrectly extracted, or misunderstood by users who view it. DEVRECON does not independently verify all User Content for accuracy, authenticity, completeness, or suitability. You are solely responsible for verifying important information before relying on it, especially where it relates to medications, dosage, timing, allergies, dietary restrictions, or another person’s health related information. Nothing in this Section limits the medical and safety disclaimers in Section 4 or the reminder and technical limitations in Section 5.

6.13Storage, retention, deletion, and backups

Your User Content may be stored locally on your device and on DEVRECON managed or third-party infrastructure as described in the Privacy Policy. Retention and deletion of User Content, including account deletion and any rolling retention limits that apply in the current version of the Service, are governed by the Privacy Policy. You are solely responsible for maintaining your own copies or backups of any User Content you consider important. DEVRECON does not guarantee that deleted, overwritten, lost, corrupted, or expired User Content can be recovered.

6.14Relationship to the Privacy Policy and other Sections

This Section must be read together with Section 3, Section 4, Section 5, Section 7, and the Privacy Policy. If there is any conflict between this Section and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy controls.

7.AI ASSISTED SCAN, OCR, AND EXTRACTION FEATURES

7.1Scope of this Section

This Section applies to any feature in the Service that allows you to upload, scan, photograph, process, or extract information from prescriptions, labels, reports, packaging, or other documents or images using OCR, AI assisted processing, or similar technologies. These features are referred to in this Section as the Scan Features. This Section supplements Section 4, Section 5, and Section 6 and does not limit any obligation you have under those Sections.

7.2Optional and user initiated feature

The Scan Features are optional convenience tools that you choose to use. You decide whether to upload or scan a document. You are solely responsible for selecting what to upload, ensuring that the uploaded material is sufficiently clear for your intended use, reviewing the extracted output, and deciding whether to save or rely on it. If you do not want your prescription content or other uploaded document content to be processed through the Scan Features, you must not use those features and should use manual entry instead.

7.3Transmission to service providers

If you choose to use the Scan Features, your uploaded image, document, or relevant extracted text may be transmitted to service providers used by DEVRECON to provide scanning, extraction, storage, and related processing functions. As described in the Privacy Policy, this may include the OpenAI API and other infrastructure providers used to operate the Service. By using the Scan Features, you acknowledge and agree to that processing as reasonably necessary to provide the feature you requested.

7.4No medical advice and no verified prescription interpretation

The Scan Features do not provide medical advice, prescription validation, dosage confirmation, clinical decision support, ingredient certification, allergen safety confirmation, or professional healthcare interpretation. Any text, fields, outputs, or suggestions generated through the Scan Features are provided only for convenience and organization. They are not a substitute for the original prescription or document, a doctor’s instructions, a pharmacist’s guidance, or other qualified professional advice.

7.5Mandatory review and verification before use

You must review and independently verify all extracted content before saving it in the App, using it to create or update reminders, sharing it with another person, relying on it for medication scheduling, or relying on it for dietary or allergen related decisions. This verification obligation applies to all important fields, including medication name, dosage strength, units, route of administration, timing, frequency, duration, refill related information, warnings, instructions, and any dietary or allergen related information. You must verify extracted information against the original document and, where appropriate, a qualified healthcare professional.

7.6OCR and AI limitations, including hallucinations

The Scan Features may produce inaccurate, incomplete, misleading, or unsafe outputs. Without limitation, extraction results may include OCR reading errors, formatting errors, omitted content, duplicated content, misread medication names, incorrect dosages or units, incorrect timing or frequency, false or hallucinated text or values not present in the original document, incorrect dietary or allergen related classifications, and failures to identify important warnings or instructions. DEVRECON does not guarantee that any scan or extraction output is accurate, complete, current, clinically valid, or suitable for any purpose.

7.7Authority to upload documents and third party information

You must not upload or scan any document through the Scan Features unless you have lawful authority and all permissions or consents required to do so. Uploaded documents may contain sensitive personal data, health related information, and third party personal or professional information, including patient details, doctor names, clinic details, contact information, signatures, and similar identifiers. If the document or data relates to another person, you represent and warrant that you have the authority to provide and process that information through the Service. If the document or data relates to a child or dependent, you represent and warrant that you are the parent, guardian, or other person with lawful authority to act for that individual.

7.8No authenticity or fraud verification

The Scan Features do not verify whether a prescription or other document is genuine, current, legally valid, issued by a licensed professional, unaltered, or sufficient for any pharmacy, insurance, legal, regulatory, or healthcare purpose. DEVRECON does not provide document authentication, provider verification, forgery detection, tamper analysis, or legitimacy review through the Scan Features.

7.9No emergency or time critical use

The Scan Features are not intended for emergency or time critical medical use. You must not use the Scan Features during a medical emergency, as a substitute for contacting a doctor or pharmacist, to make urgent dosage decisions, or to confirm urgent allergen or safety issues. If there is an urgent medical concern, you must seek immediate assistance from local emergency services or a qualified healthcare professional.

7.10Image quality and device limitations

Scan quality and extraction performance depend on factors outside DEVRECON’s control, including camera quality, lighting conditions, glare, blur, shadows, angle distortion, handwriting legibility, language or script formatting, document damage, folds, device performance, and operating system or app version limitations. Poor quality uploads materially increase the risk of incorrect or incomplete extraction. If a scan result is unclear, incomplete, or inaccurate, you must re scan the document or use manual entry instead.

7.11Feature changes, provider changes, and suspension

DEVRECON may modify, limit, suspend, or discontinue the Scan Features at any time for legal, security, technical, operational, product, or provider related reasons. This includes changes arising from platform requirements or third party provider availability. We may also restrict or disable access to the Scan Features if we reasonably believe that you are misusing the feature, uploading unauthorized third party documents, violating these Terms, or creating legal, privacy, security, or safety risk.

7.12Responsibility for scan related use

You are solely responsible for the documents and images you upload, the legality of uploading them, the accuracy of any information you save after review, and any decision or action you take based on scan results or extraction outputs. Nothing in this Section reduces your obligations under Section 4, Section 5, or Section 6. To the maximum extent permitted by applicable law, DEVRECON is not responsible for harm arising from your failure to independently verify scan outputs before using or relying on them.

7.13Relationship to the Privacy Policy

This Section must be read together with the Privacy Policy, which explains what scan related data may be processed, which categories of service providers may process it, how deletion and retention are handled, and what choices you have in relation to scanning and uploads. If there is any conflict between this Section and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy controls.

8.SERVICE AVAILABILITY, SYNCING, AND THIRD PARTY DEPENDENCIES

8.1Scope of this Section

This Section governs the availability, performance, synchronization behavior, and third party service dependencies of the Service. This Section supplements Section 5, Section 6, and Section 7. Where a provision in Section 5 applies specifically to reminders or notifications, Section 5 controls for that subject matter.

8.2No guarantee of continuous availability

The Service may be unavailable, interrupted, delayed, degraded, or partially functional from time to time. DEVRECON does not guarantee that the Service, or any feature of the Service, will be available at all times, operate without interruption, or function without error on every device, operating system version, network, or region.

8.3Device, operating system, connectivity, and permission dependence

The Service depends on your device hardware, operating system, app version, internet connectivity, local storage, battery condition, system services, and required permissions. The Service may not function properly, or may not function at all, if your device is offline, has weak or unstable connectivity, is in low power mode, has restricted background activity, has insufficient storage, has denied required permissions, or is running an outdated or unsupported operating system or app version. You are responsible for maintaining a compatible device, a supported app version, required permissions, and appropriate device settings.

8.4Synchronization is not real time and may fail or conflict

If the Service supports synchronization across devices, sessions, or shared users, including Family Sharing features, synchronization is provided on a reasonable efforts basis and is not guaranteed to be real time, complete, or conflict free. Changes made on one device or by one user may be delayed, may fail to appear, may appear differently on another device, or may be duplicated, merged incorrectly, overwritten, or shown in a temporarily inconsistent state. You must not assume that information visible on one device or account view is immediately or perfectly reflected everywhere else. You are responsible for verifying critical information on the specific device and account view on which you actually rely.

8.5Offline access and stale data risk

Some features of the Service may have limited offline functionality, while other features may require an active internet connection. Information shown while your device is offline, cached, or not recently synchronized may be stale, incomplete, or inaccurate. You must refresh and verify important information before relying on it for medication, reminder, adherence, sharing, or other health related purposes.

8.6Maintenance, updates, outages, and feature changes

DEVRECON may perform maintenance, install patches, release updates, apply security changes, or make infrastructure or feature modifications from time to time. During those periods, some or all parts of the Service may be unavailable or may function differently. We may also add, modify, limit, suspend, or discontinue features at any time for technical, legal, security, operational, compliance, or product reasons. DEVRECON does not guarantee any minimum uptime, response time, synchronization speed, or continued availability of any specific feature.

8.7Third party services and infrastructure

The Service relies on third party services and platform components to operate. Depending on the feature, this may include cloud hosting and storage providers, authentication and account security providers, notification delivery services, analytics and diagnostics providers, sign in providers, and optional scanning or extraction providers. Availability, performance, routing, and reliability of the Service may therefore be affected by factors outside DEVRECON’s direct control, including provider outages, platform restrictions, service degradation, throttling, configuration changes, policy changes, connectivity issues, and failures of external infrastructure. DEVRECON is not responsible for the independent acts or omissions of third party services that we do not control, subject to applicable law and subject to our responsibilities under the Privacy Policy for our own handling of personal data.

8.8Provider and platform changes

DEVRECON may add, replace, reconfigure, limit, or remove service providers, software development kits, integrations, or infrastructure components used to operate the Service. We may also modify the Service as needed to respond to changes in device platforms, operating systems, app store requirements, third party provider availability, security risks, or legal and compliance requirements. If a provider or infrastructure change materially affects how personal data is handled, we will address that change in the Privacy Policy and provide any notice or obtain any consent required by applicable law.

8.9No reliance for critical continuity or preservation

You must not rely on the Service as your only system for storing, preserving, or accessing critical information. You are responsible for maintaining independent methods to confirm important medication schedules, reminders, and records, especially where delay, loss of connectivity, sync failure, device change, or service interruption could create risk. Nothing in this Section reduces your obligations under Section 4, Section 5, Section 6, or Section 7 to review and verify important information independently.

8.10Relationship to the Privacy Policy

This Section must be read together with the Privacy Policy, which explains the categories of service providers we use, the current providers used by the Service, how synchronization and storage related data may be handled, and how international or cross border processing may occur. If there is any conflict between this Section and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy controls.

9.SUSPENSION, RESTRICTION, TERMINATION, AND ACCOUNT DELETION

9.1Scope of this Section

This Section explains when DEVRECON may suspend, restrict, or terminate access to the Service, when you may stop using the Service or delete your account, and what happens to your access and data after suspension, termination, or deletion. This Section must be read together with Section 2, Section 6, Section 8, and the Privacy Policy.

9.2Your right to stop using the Service

You may stop using the Service at any time. However, uninstalling the App, signing out, or ceasing to use the Service does not by itself delete your account or remove associated personal data from our active systems. If you want your account deleted, you must use an available account deletion method described in this Section and in the Privacy Policy.

9.3Suspension or restriction by DEVRECON

DEVRECON may suspend, restrict, or limit your access to the Service, your account, or specific features where reasonably necessary for security, fraud prevention, abuse prevention, legal compliance, operational integrity, enforcement of these Terms, platform compliance, or protection of users, third parties, or the Service. Depending on the circumstances, this may include temporarily disabling sign in, limiting use of certain features, requiring reauthentication or verification, restricting access to shared content, or otherwise preventing access until the issue is resolved.

9.4Immediate action in higher risk situations

We may act without prior notice where advance notice would create security risk, enable abuse, interfere with investigation, expose another person’s data, or otherwise create legal, operational, or safety concerns. Where appropriate and legally permitted, we may notify you after the action has been taken.

9.5Adults only enforcement and false eligibility information

MyMedicals is strictly limited to users who are at least 18 years old. If we reasonably determine that you are under 18, or that you provided false or misleading date of birth or other eligibility information, we may suspend, restrict, or terminate your account and take related action permitted by law and these Terms. Any resulting handling of personal data, including deletion and limited retention, will be governed by the Privacy Policy.

9.6Termination or closure by DEVRECON

DEVRECON may terminate your account or permanently discontinue your access to the Service where reasonably necessary, including where you materially or repeatedly violate these Terms, are ineligible to use the Service, misuse the Service, create legal or security risk, use the Service in an unauthorized jurisdiction, or where we are required to do so by law, lawful request, platform requirement, or provider constraint. We may also discontinue the Service or part of the Service for technical, operational, legal, compliance, or product reasons. Where required by applicable law, we will provide any notice that is legally required.

9.7Inactive accounts

As described in the Privacy Policy, if your account shows no sign in activity and no medical data updates for an extended period, we may delete the inactive account and associated data in order to reduce the amount of personal data we retain. In the current version of the Service, this may occur after 12 months of inactivity. Where feasible and appropriate, we may attempt to provide notice to your registered email address before deleting an inactive account.

9.8Account deletion by you

You may request deletion of your MyMedicals account at any time. The primary deletion method is the in app deletion flow made available through account or profile settings. If you cannot access the App or cannot complete deletion in app, you may request deletion through the official channels described in the Privacy Policy and Section 15, including by contacting support from the email address registered to your account. Account deletion is permanent and is not the same as uninstalling the App, signing out, or temporarily stopping use.

9.9Verification and processing of deletion requests

To protect your account against unauthorized deletion, DEVRECON may require reasonable verification before processing a deletion request made outside the App or in any situation where verification is reasonably necessary. Deletion handling, verification steps, and applicable timing are governed by the Privacy Policy. Where deletion is not processed instantly, a reasonable processing period may apply, subject to applicable law and the Privacy Policy.

9.10Effects of suspension, restriction, termination, or deletion

If your account is suspended, restricted, terminated, or deleted, you may lose access to your account, User Content, reminders, schedules, adherence history, uploads, and sharing related features. Some or all Service functionality may stop working for your account. Synchronization to your devices may stop. Shared access or Family Sharing permissions may be disabled. DEVRECON may remove, disable, or stop displaying associated content or features where reasonably necessary, subject to legal and technical constraints. DEVRECON is not responsible for losses resulting from suspension, restriction, termination, or deletion carried out in accordance with these Terms and applicable law.

9.11Shared content and recipient copies after deletion or revocation

If you shared information with another user through Family Sharing or any other in app sharing feature, deleting your account or revoking sharing may stop future access through MyMedicals, but it may not remove information that the recipient already viewed, remembered, copied, exported, recorded, or captured outside the Service. DEVRECON is not responsible for information retained or reused by a recipient after you chose to share it.

9.12Retention after termination or deletion

Even after suspension, termination, or account deletion, DEVRECON may retain limited data where permitted or required by law or where reasonably necessary for legal compliance, fraud prevention, abuse prevention, security investigations, audit and recordkeeping, dispute handling, enforcement of these Terms, backup integrity, or system recovery. Retention and deletion practices, including current retention windows for certain categories of data, are governed by the Privacy Policy. If there is any conflict between this Section and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy controls.

9.13Reinstatement and restoration

If your account is suspended or restricted, you may contact us through the official support channels identified in these Terms. However, DEVRECON is not obligated to reinstate access, restore deleted accounts, recover deleted User Content, or restore features that were removed for legal, safety, security, technical, or compliance reasons.

9.14Survival

Suspension, restriction, termination, or deletion of your account does not affect provisions of these Terms that by their nature should continue after access ends. This includes, to the extent permitted by law, provisions relating to ownership, license restrictions, User Content rights, medical and safety disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and any accrued rights or obligations that arose before access ended.

10.FEES, PAYMENTS, AND OFFICIAL COMMUNICATIONS

10.1Scope of this Section

This Section explains the current fee status of the Service, how future paid features may be introduced if DEVRECON chooses to do so, how you should identify legitimate payment related communications, and how DEVRECON may send official non marketing communications to you in connection with the Service.

10.2Current fee status

Unless expressly stated otherwise inside the App or in an updated version of these Terms, MyMedicals is currently provided without subscription fees, one time purchase fees, or charges for core use of the Service. DEVRECON does not currently require payment to create an account, use basic reminder and record keeping features, receive ordinary support, or request account deletion.

10.3No unofficial payment requests

You must treat as suspicious any request for money that claims to be required to unlock core app access, restore ordinary access, avoid suspension, receive ordinary support, or process account deletion, unless that request is clearly presented through an official in app purchase flow or another official payment method expressly identified by DEVRECON. DEVRECON does not require payment through personal bank accounts, personal UPI identifiers, personal digital wallets, gift cards, cryptocurrency wallets, or informal chat based requests in order to provide core MyMedicals services.

10.4Future paid features or subscriptions

DEVRECON may in the future introduce optional paid features, premium tools, subscriptions, or other monetized functionality. If that occurs, DEVRECON will present the applicable pricing, billing terms, feature scope, and any material conditions through the App, through the relevant app store purchase flow where applicable, or through an updated version of these Terms. Unless expressly stated otherwise, introduction of a paid feature will not by itself convert previously free core access into a retroactive payment obligation.

10.5Platform billing and third party payment processing

If DEVRECON introduces paid features through the Apple App Store, Google Play, or another authorized payment channel, the purchase, billing, renewal, cancellation, refund, and related payment handling may be subject to that platform or payment provider’s own terms, rules, and procedures in addition to these Terms. DEVRECON is not responsible for independent billing actions, delays, or platform specific payment handling carried out by a platform or payment processor that DEVRECON does not control, except to the extent required by applicable law.

10.6Anti impersonation and fraud protection

You must not rely on social media messages, unofficial chat accounts, personal messaging numbers, or unverified third party channels for payment requests, account critical requests, or legal notices relating to MyMedicals. If you receive a suspicious message, impersonation attempt, or unauthorized payment demand claiming to be from DEVRECON, you should not make any payment or disclose sensitive information and should contact DEVRECON through the official channels identified in Section 15 and the Privacy Policy.

10.7Official service communications from DEVRECON

DEVRECON may send you official non marketing communications relating to your account, the Service, reminders, security, support, legal compliance, operational issues, or changes to these Terms or the Privacy Policy. These communications may be sent through in app notices, email, push notifications if you have enabled them on your device, or publication within the App or on an official MyMedicals or DEVRECON webpage referenced by the App. You are responsible for keeping your account contact information current and for reviewing important notices sent through those official channels.

10.8No third-party marketing communications and relationship to the Privacy Policy

As described in the Privacy Policy, DEVRECON does not use your personal data to send third party marketing communications or to show targeted advertisements through the Service. This Section must be read together with Section 9, Section 15, and the Privacy Policy. If there is any conflict between this Section and the Privacy Policy on a personal data or privacy related issue, the Privacy Policy controls.

11.INDEMNIFICATION

11.1Scope of this Section

This Section explains when you may be responsible for losses, claims, or liabilities arising from your own conduct, your User Content, your misuse of the Service, or your breach of these Terms. This Section must be read together with Section 2, Section 3, Section 6, Section 7, Section 9, and Section 12.

11.2Your indemnification obligation

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless DEVRECON Softwares Private Limited, and its directors, officers, employees, contractors, and licensors, from and against third party claims, proceedings, liabilities, damages, losses, and reasonable costs arising out of or relating to your breach of these Terms, your unlawful use of the Service, your User Content, or your violation of applicable law or third party rights.

11.3Claims covered by this Section

Without limiting Section 11.2, your indemnification obligation may apply where a third party claim arises from your misuse of the Service, your prohibited conduct under Section 3, your false or misleading information, your unauthorized upload, scan, storage, or sharing of another person’s information, your lack of authority to act for another person, your infringement of another person’s privacy, confidentiality, intellectual property, or other legal rights, or your use or sharing of inaccurate or unverified information that you entered, uploaded, scanned, extracted, or shared through the Service.

11.4Family Sharing, third party data, and uploaded materials

If you use the Service in relation to another person, including through Family Sharing, shared records, uploads, or scanning of prescriptions or other documents, you are solely responsible for ensuring that you have the lawful authority and permissions required to do so. Your indemnification obligation may apply to third party claims arising from your lack of authority, your unauthorized disclosure or sharing of another person’s data, or your handling of another person’s documents or records through the Service in violation of these Terms or applicable law.

11.5Reasonable scope of recoverable costs

Subject to applicable law, recoverable amounts under this Section may include amounts reasonably incurred in responding to or resolving a covered third party claim, including court costs, settlement amounts, and reasonable legal and professional fees. However, this Section does not require you to indemnify DEVRECON for losses to the extent they are finally determined by a court or tribunal of competent jurisdiction to have been caused by DEVRECON’s own gross negligence, willful misconduct, or violation of non waivable rights under applicable law.

11.6Control of defense and cooperation

If DEVRECON seeks indemnification under this Section, DEVRECON may provide you notice of the claim using the contact details associated with your account, where reasonably practicable. You agree to cooperate reasonably in relation to the claim. DEVRECON may control the defense or resolution of the claim, provided that DEVRECON will not agree to a settlement that imposes an express admission of wrongdoing or a direct payment obligation on you without your consent, unless required by law or final order.

11.7No expansion beyond applicable law

Nothing in this Section limits any rights or protections you may have under applicable law that cannot lawfully be waived or limited by contract. If any part of this Section is unenforceable in a particular jurisdiction or circumstance, it will be enforced only to the maximum extent permitted by applicable law.

11.8Survival

This Section survives suspension, restriction, termination, or deletion of your account to the extent a covered claim relates to your conduct, your User Content, or your use of the Service before access ended.

12.DISCLAIMERS OF WARRANTIES AND LIMITATION OF LIABILITY

12.1Scope of this Section

This Section explains the warranties that DEVRECON disclaims, the categories of loss for which DEVRECON does not assume liability, and the limits that apply to any claim arising out of or relating to the App, the Service, or these Terms. This Section must be read together with Section 4, Section 5, Section 6, Section 7, and Section 11. Nothing in these Terms is intended to exclude or limit any right or remedy that cannot lawfully be excluded or limited under applicable law.

12.2Service provided on an as is and as available basis

To the maximum extent permitted by applicable law, the App and the Service are provided on an as is and as available basis. DEVRECON does not warrant that the App or the Service will be uninterrupted, error free, secure, complete, current, available at all times, or free from delays, outages, defects, or harmful components.

12.3No medical, clinical, or professional warranty

DEVRECON does not warrant or represent that the Service is medically accurate, clinically appropriate, safe for emergency use, suitable for any particular health related purpose, or capable of replacing professional advice. MyMedicals does not provide medical advice, diagnosis, treatment, or clinical decision support. Any information presented through the Service may be incomplete, inaccurate, delayed, user generated, incorrectly extracted, or unsuitable for your circumstances. You remain solely responsible for consulting qualified professionals and independently verifying important health related information before relying on it.

12.4No warranty for reminders, notifications, syncing, or device behavior

DEVRECON does not warrant that any reminder, alert, push notification, in app notice, synchronization event, or shared update will be delivered, delivered on time, displayed correctly, heard by you, reflected across devices immediately, or preserved without conflict or error. Reminder and synchronization performance may be affected by factors outside DEVRECON’s direct control, including device settings, operating system behavior, internet connectivity, background restrictions, platform services, and third party infrastructure.

12.5No warranty for User Content, uploaded documents, or scan outputs

DEVRECON does not warrant that User Content, uploaded documents, extracted text, OCR output, or AI assisted scan output will be accurate, complete, authentic, clinically valid, legally sufficient, or fit for any particular purpose. Optional scan and extraction features are convenience tools only. Any output generated through those features must be independently reviewed and verified by you against the original document and, where appropriate, with a qualified professional.

12.6Disclaimer of implied warranties

To the maximum extent permitted by applicable law, DEVRECON disclaims all warranties and conditions, whether express, implied, statutory, or otherwise, including any implied warranties or conditions of merchantability, fitness for a particular purpose, satisfactory quality, title, non infringement, quiet enjoyment, and accuracy or reliability of data or outputs.

12.7Exclusion of indirect and consequential damages

To the maximum extent permitted by applicable law, DEVRECON will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to the App, the Service, or these Terms, even if DEVRECON has been advised of the possibility of such damages. This exclusion applies to all legal theories, including contract, tort, negligence, statutory claims, misrepresentation, restitution, or otherwise.

12.8Categories of excluded loss

Without limiting Sections 12.2 through 12.7, and to the maximum extent permitted by applicable law, DEVRECON will not be liable for loss, damage, injury, cost, or harm arising out of or relating to missed, delayed, duplicated, or suppressed reminders or notifications, sync delays or sync conflicts, stale or inconsistent data, user entry mistakes, failure to verify information, scan or OCR errors, AI generated inaccuracies or hallucinations, data loss or corruption, service outages, third party provider failures, platform infrastructure issues, device level restrictions, or your reliance on the Service for emergency, time critical, clinical, or safety sensitive decision making.

12.9Aggregate liability cap

To the maximum extent permitted by applicable law, DEVRECON’s total aggregate liability to you for all claims arising out of or relating to the App, the Service, or these Terms will not exceed the greater of the total amount, if any, that you paid directly to DEVRECON for the Service in the twelve months immediately preceding the event giving rise to the claim, or INR 1,000. This limitation applies even if any remedy fails of its essential purpose.

12.10Mandatory legal carve outs and non waivable rights

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including your non waivable statutory rights. Nothing in this Section excludes or limits DEVRECON’s liability to the extent finally determined by a court or tribunal of competent jurisdiction to arise from DEVRECON’s gross negligence, willful misconduct, fraud, or death or personal injury caused by DEVRECON’s negligence, where such carve outs are required by applicable law.

12.11Interpretation and partial enforceability

If any disclaimer, exclusion, or limitation in this Section is held unenforceable in whole or in part under applicable law, that provision will be enforced only to the maximum extent permitted by law, and the remaining parts of this Section will continue in effect.

12.12Survival

This Section survives suspension, restriction, termination, deletion of your account, and discontinuation of your use of the Service to the extent permitted by applicable law.

13.DISPUTE RESOLUTION, GOVERNING LAW, AND JURISDICTION

13.1Scope of this Section

This Section governs how disputes, claims, complaints, and legal proceedings arising out of or relating to the App, the Service, these Terms, or your relationship with DEVRECON will be handled. This Section must be read together with Section 9, Section 11, Section 12, Section 15, and the Privacy Policy.

13.2Good faith pre dispute notice

Before starting formal legal proceedings, you agree to first contact DEVRECON in good faith using the official contact channels identified in Section 15 or, for privacy related grievances, the grievance channel identified in the Privacy Policy. Your notice should include sufficient information for us to understand and review the issue, including your name, the email address associated with your account if available, a clear description of the issue, the approximate date or period when it occurred if known, and the resolution you are seeking. You may also include relevant screenshots, records, or supporting material.

13.3Informal resolution period

You and DEVRECON agree to attempt informal resolution for at least thirty days after a complete dispute notice is received before either party starts court proceedings, unless immediate action is reasonably necessary for urgent relief, security incidents, fraud, unauthorized access, preservation of evidence, compliance with law, or another situation where waiting would be unreasonable or legally inappropriate. Nothing in this Section prevents either party from taking steps reasonably necessary to prevent imminent harm.

13.4Governing law

These Terms, and any dispute or claim arising out of or relating to these Terms, the App, or the Service, will be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.5Jurisdiction and forum

Subject to applicable law and any non waivable statutory rights or remedies available to you, the courts located in Hyderabad, Telangana, India will have jurisdiction over disputes or claims arising out of or relating to these Terms, the App, or the Service. You and DEVRECON submit to the jurisdiction of those courts for such matters.

13.6Privacy grievances and privacy related disputes

If your concern relates specifically to the processing of personal data, privacy, deletion, access, correction, nomination, or another privacy related matter, you may use the privacy and grievance contact channels identified in the Privacy Policy before pursuing formal legal remedies. Privacy grievances will be handled in accordance with the grievance framework described in the Privacy Policy. Nothing in this Section overrides any grievance or complaint process that applicable law makes available to you in relation to personal data or consumer rights.

13.7Non waivable consumer and statutory rights preserved

Nothing in these Terms is intended to restrict, waive, or override any non waivable rights or remedies available to you under applicable law, including consumer protection rights, statutory complaint mechanisms, or rights relating to personal data that cannot lawfully be excluded or limited by contract. This Section will be enforced only to the maximum extent permitted by applicable law.

13.8Urgent and protective relief

Nothing in this Section prevents either you or DEVRECON from seeking urgent, interim, injunctive, or protective relief from a court of competent jurisdiction where such relief is available under applicable law and is reasonably necessary to prevent imminent harm, protect privacy or confidential information, preserve evidence, address security incidents, or prevent misuse of the Service.

13.9Time limits and preservation of records

Each party must bring claims within the time period required by applicable law. Nothing in these Terms shortens any limitation period where such shortening is prohibited by law. Because disputes relating to the Service may involve account activity, notifications, synchronization behavior, uploads, scans, support communications, and other technical records, both parties should preserve relevant records, screenshots, and communications once a dispute becomes reasonably foreseeable.

13.10Costs and fees

Unless otherwise required by applicable law or ordered by a court of competent jurisdiction, each party will bear its own legal fees and costs in connection with a dispute. Nothing in this Section limits a party’s right to seek recovery of costs or fees where such recovery is available under applicable law or by court order.

13.11Severability and survival

If any part of this Section is held invalid, unenforceable, or inapplicable, the remaining parts will continue in effect to the maximum extent permitted by law. This Section survives suspension, restriction, termination, deletion of your account, and discontinuation of your use of the Service.

14.OWNERSHIP, FEEDBACK, ENFORCEMENT RIGHTS, AND GENERAL LEGAL TERMS

14.1Scope of this Section

This Section governs ownership of the App and the Service, feedback you submit, DEVRECON’s general enforcement rights, and the general legal rules that apply to interpretation and operation of these Terms. This Section must be read together with Section 3, Section 6, Section 9, Section 13, and Section 15.

14.2Ownership of the App and the Service

The App, the Service, and all related software, designs, layouts, text, graphics, interfaces, features, compilations, branding, logos, and underlying technology, excluding your User Content, are owned by or licensed to DEVRECON and are protected by applicable intellectual property and other laws. Except for the limited rights expressly granted to you under these Terms, DEVRECON and its licensors reserve all rights, title, and interest in and to the App and the Service.

14.3License only and no transfer of ownership

Your access to and use of MyMedicals is licensed and not sold to you. Nothing in these Terms transfers to you any ownership right in the App, the Service, or any DEVRECON intellectual property. You receive only the limited rights expressly granted in these Terms, subject to your continued compliance with them.

14.4Trademarks and brand use

The MyMedicals name, the DEVRECON name, and any associated logos, marks, product names, design elements, or branding used in connection with the App or the Service are owned by DEVRECON or its licensors, unless otherwise stated. You must not use them without prior written permission, except where use is permitted by law solely to refer to the App in an accurate and non misleading manner.

14.5Feedback and suggestions

If you submit feedback, ideas, suggestions, feature requests, bug reports, or other comments about the App or the Service, you grant DEVRECON a nonexclusive, worldwide, royalty free, transferable, sublicensable license to use, reproduce, adapt, modify, publish, distribute, and otherwise use that feedback for lawful business purposes, without any obligation to compensate you. This does not transfer ownership of your User Content under Section 6. It applies only to voluntary feedback about the App or the Service.

14.6General enforcement rights

DEVRECON may take reasonable steps to enforce these Terms and protect users, the Service, third parties, and DEVRECON’s legal and operational interests. Such steps may include warnings, access restrictions, feature limitations, suspension, termination, preservation of relevant records, cooperation with lawful requests, and other measures permitted by these Terms and applicable law. Nothing in this Section expands DEVRECON’s rights beyond what is otherwise stated in these Terms or permitted by law.

14.7Assignment by DEVRECON

DEVRECON may assign, transfer, delegate, or otherwise dispose of these Terms, in whole or in part, including in connection with a corporate reorganization, merger, acquisition, asset sale, financing, outsourcing arrangement, or transfer of the Service, provided that any such transfer does not reduce any non waivable rights you have under applicable law.

14.8No assignment by you

You may not assign, transfer, delegate, sublicense, or otherwise dispose of your rights or obligations under these Terms without DEVRECON’s prior written consent. Any attempted assignment or transfer by you in violation of this Section is void to the extent permitted by law.

14.11Entire agreement and order of precedence

These Terms, together with the Privacy Policy and any in app notices or feature specific disclosures that expressly apply to your use of the Service, form the entire agreement between you and DEVRECON regarding the App and the Service. If there is a conflict between these Terms and another applicable document, the following order applies. The Privacy Policy controls for privacy, personal data handling, retention, deletion, grievance, and related privacy matters. A feature specific disclosure controls only for that specific feature to the extent it expressly states that it supplements these Terms. In all other cases, these Terms control.

14.12No third party beneficiaries except where expressly stated

Except where these Terms expressly state otherwise, these Terms do not create any third party beneficiary rights in any person or entity. For iOS users only, where required by applicable Apple platform terms, Apple and its subsidiaries are third party beneficiaries of the provisions in these Terms that expressly relate to the iOS version of the App, and Apple will have the right to enforce those provisions against you as a third party beneficiary.

14.13Survival

Any part of these Terms that by its nature should continue after suspension, restriction, termination, deletion of your account, or discontinuation of the Service will survive to the extent permitted by law. This includes provisions relating to ownership, feedback licenses, disclaimers, limitation of liability, indemnification, dispute resolution, and general interpretation rules.

15.CHANGES TO THESE TERMS AND CONTACT DETAILS

15.1Scope of this Section

This Section explains how DEVRECON may update these Terms, how updated Terms will be published, when changes become effective, what you may do if you do not agree to an update, and the official contact channels for support, privacy matters, grievances, complaints, and legal notices. If DEVRECON makes a material change to these Terms, we will provide notice in a reasonable manner before the change takes effect, or as otherwise required or permitted by applicable law. Material changes may include changes that materially affect your rights, obligations, available features, account handling, dispute process, or risk allocation. Notice of a material change may be provided through an in app notice, by email to the address associated with your account if available, or by another reasonable method consistent with the Service and applicable law.

15.5Immediate or urgent changes

In some cases, DEVRECON may need to make changes that take effect immediately or on shorter notice, including where reasonably necessary for legal compliance, platform compliance, security, fraud prevention, abuse prevention, or prevention of imminent harm. Where advance notice is not reasonably possible, we may provide notice as soon as practicable after the change is made.

15.6Effective date and continued use

Unless we state otherwise, updated Terms become effective on the date identified in the updated version when they are published as described in this Section. Subject to applicable law, your continued access to or use of the Service after updated Terms become effective constitutes your acceptance of those updated Terms.

15.7If you do not agree to updated Terms

If you do not agree to updated Terms, you must stop using the Service. If you wish to discontinue use and delete your account, you may use the account deletion methods described in Section 9 and in the Privacy Policy. Accessing the Service solely for the limited purpose of reviewing updated Terms, contacting support, or requesting deletion will not by itself be treated as acceptance of a new term where applicable law requires a different result.

15.10Information you should include in your request

DEVRECON may send official notices, service related communications, and updates concerning these Terms, the Service, your account, security matters, or legal and operational issues through one or more official channels, including in app notices, email to the address associated with your account, push notifications if enabled on your device, or publication within the App or on an official MyMedicals or DEVRECON webpage referenced by the App. You are responsible for keeping your contact information current and for reviewing important notices made available through those official channels.

15.12Legal notices to DEVRECON

Unless applicable law requires a different method, legal notices, claims notices, or formal communications relating to these Terms, the Service, or a dispute with DEVRECON should be sent to management@devrecon.in and, where appropriate, to the registered office postal address listed in Section 15.8. This Section does not override any non waivable legal rule governing formal service of legal process.

15.13Contact detail changes

DEVRECON may update its support, privacy, grievance, or notice contact details from time to time by updating these Terms, the Privacy Policy, or the official contact information shown in the App. You are responsible for using the most current official contact details published by DEVRECON.

15.14Relationship to the Privacy Policy
